The petitioner is accused in connection with BISFI P.S. Case No. 208 of 2019, registered under Sections 379 and 420 of the Indian Penal Code.

The accusation is that informant, Md. Sahwaj, went to SBI Branch situated at Ausi Zero Mile and withdrawn Rs.22,500/- through cheque. At that time, one person came near him and handed over Rs.1,00,000/- wrapped in handkerchief and took Rs.22,500/-from him for depositing in the bank but he did not returned. When he opened the handkerchief then he found the papers wrapped in the handkerchief. On 18.07.2019, when he again went at the said bank then saw that person was

No.74442 of 2019(2) dt.18-12-2019 2/2 moving in the bank then he informed the bank officials and thereafter, that person was apprehended, who disclosed his name as Ram Sumir Mahto @ Subnil Mahto (petitioner). On search, papers were found folded in handkerchief from his pocket. Learned counsel for the petitioner submits that petitioner has no criminal antecedent and is in custody since 18.08.2019.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Benipatti, Madhubani, in connection with BISFI P.S. Case No. 208 of 2019. Out of two sureties, one surety must be the close relative of the petitioner.
