The petitioner seeks bail in connection with Kanti P.S. Case No. 719 of 2019 registered for the offences punishable under Sections 341, 323, 379/34 of the Indian Penal Code and Section 37(C) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that there is no no recovery from the conscious possession of the petitioner rather petitioner is intoxicated condition. Learned counsel for the petitioner further submits that the petitioner has no criminal antecedent and he is in jail custody since 23.09.2019. In the facts and circumstances of the case, I am inclined to grant bail to the petitioner, subject to deposit of
