Mr. Dilip Kumar No.I, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 21-11-2019 Heard learned counsel for the petitioners and learned APP for the State.

The petitioners are apprehending his arrest in a case registered for the offence punishable under Sections 147,148,323,307,353,379 of the IPC.

According to the FIR, the informant is Jr. Engineer, electric Supply Division, Sikta. On 20.07.2019 at about 9.50 PM the informant received information that some unknown miscreants came at power station and started abusing and assaulting to the staff of power station and snatched departmental mobile bearing

Patna High Court CR. MISC. No.73610 of 2019(2) dt.21-11-2019 2/2 no.7368800210 for closing the power supply. Due to this reason, the power supply obstructed about 45 minutes and sustained a loss of Rs.19,500/- to the electricity department.

The learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence and have falsely been implicated in this case due to police mechanism. The learned counsel for the petitioners further submits that no specific allegations against the petitioners and they have no criminal antecedent.

In the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Bettiah, West Champaran in connection with Sikta P.S. Case No.54/2019, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
