JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-11-2019 Petitioner seeks bail in connection with Hussainganj P.S. Case No. 282 of 2018 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 504, 506 and later on Section 302 IPC has been added.
As per FIR petitioner happens to be order-giver and there is allegation against him and other accused persons that they have assaulted the uncle of the informant, causing injuries to him and earlier case was lodged under Section 307 IPC but later on Section 302 IPC was added as uncle of informant has died.
Submission of learned counsel for the petitioner is that petitioner is aged 65 years and he has falsely been implicated and he is in custody for about 2 and a half months
Patna High Court CR. MISC. No.73719 of 2019(2) dt.25-11-2019 2/2 and other co-accused against whom there is allegation of assault has been granted bail by a co-ordinate Bench of this Court by order dated 29.8.2019 passed in Cr.Misc.No. 53242 of 2019. It is further submitted that charge sheet has already been submitted in this case.
Heard learned APP also.
In view of above facts and circumstances, let petitioner be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan, in connection with Hussainganj P.S. Case No. 282 of 2018, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and he has to co-operate in disposal of the trial and appear in the court as and when required.
