JUSTICE ARUN KUMAR ORAL ORDER 01-02-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Khanpur PS Case No. 134 of 2017 registered under Sections 120(B), 201 and 302/34 of the IPC.
The allegation in brief is that a day prior to lodging of the FIR in the night the accused persons entered into the house of the informant, assaulted him and his wife, kidnapped his daughter and on the next day in the after-noon her dead body was found. Learned Counsel for the petitioner submits that both sides are on inimical terms, the alleged occurrence is said to be a day prior to lodging of the FIR in the night but no information was lodged till next day morning and after recovery of the dead body this FIR was lodged. The petitioner is in custody since 8.11.2017 and has no criminal antecedent except one complaint case. Having considered the said facts and circumstances, the petitioner, namely, Sheela Devi is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of SDJM Samastipur in connection with Khanpur PS Case No. 134 of 2017.
