====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 24-01-2025 Heard Mr. Ravi Prakash, learned counsel for the petitioner, Mr. Dilip Kumar No.1, learned APP for the State and Mr. Anant Kumar Bhaskar, learned counsel for the informant.

2. The petitioner seeks bail in a case registered for the offence punishable under Sections 364/34 of the Indian Penal Code.

3. Though, the prayer for anticipatory bail of the petitioner was rejected by this Court vide order dated 16.03.2023 passed in Cr. Misc. No.55550 of 2022, with a direction to the petitioner to surrender before the Court below and seeks regular bail, but the petitioner surrendered before the Court below after about one year.

4. As per the prosecution case, the petitioner along with co-accused persons forcibly took away the husband of the informant on four wheeler vehicle. Informant suspects that they might have killed her husband.

5. Learned counsel for the petitioner submits that no such occurrence as alleged ever took place. He is quite innocent and has been falsely implicated in this case. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. He submits that there is no eyewitness to the present case, only on the basis of suspicion petitioner is made accused in the present case. Co-accused has been enlarged on bail by a co-ordinate bench of this court vide order dated 12.09.2023 passed in Cr. Misc. No. 60480 of 2023. The petitioner has one criminal antecedent and has been languishing in custody since 30.07.2024.

6. Learned APP for the State as well as learned counsel for the informant opposed the bail petition.

7. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail after framing of charge on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Jaynagar P.S. Case No.71 of 2021.
