1. Heard the learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks regular bail in a case registered for the offence under Section 304B/34 of the Indian Penal Code but later on section 302/34 of the IPC was added on 19.09.2023.

3. As per the prosecution case, deceased was killed for demand of dowry.

4. Learned counsel for the petitioner submits that U.D. Case No. 05 of 2023 was registered on the written application of the father of the deceased in which it has been mentioned that the deceased has committed suicide. The petitioner is in custody since 19.09.2023.

5. Learned A.P.P. has vehemently opposed the

Patna High Court CR. MISC. No.83875 of 2023(2) dt.10-01-2024 2/2 prayer for bail.

6. Considering the facts and circumstances of the case, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Mohaniya/concerned Court below in connection with Mohaniya P.S. Case No. 384 of 2023 subject to the condition that:- 7(1) The petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and on absence on two consecutive dates without sufficient reason, the bail bond shall be cancelled by the Court below.
