JUSTICE MADHURESH PRASAD ORAL ORDER 05-04-2018 Heard counsel for the petitioner and the State. Petitioner is an accused in a case registered for offence under section 384 IPC.
Learned counsel for the petitioner submits that neither mobile phone from which ransom call was made nor the account number in which ransom was directed to be deposited belongs to the petitioner and he has falsely been implicated in this case on the confessional statement of co-accused Niranjan Kumar Bhagat who has already been granted bail vide order dated 10.11.2017, passed in Cr Misc No.52036 of 2017. Petitioner has been remanded in this case on 4.1.2017. Prior to the lodging of this case, he is accused in other cases mentioned in paragraph 3 of the bail application.
Considering the aforesaid submissions, prayer for bail of
Patna High Court Cr.Misc. No.11461 of 2018 (3) dt.05-04-2018 the petitioner is allowed. Let the petitioner, mentioned above, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa in Sadar Police Station Case No. 527 of 2015 on the following conditions:- One of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner. The Petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
