In this case, the petitioner is seeking regular bail in connection with Bakhtiyarpur P.S. Case No.560 of 2017, registered for the offence under Sections 363/366-A/34 of the Indian Penal Code and under Section 12 of the POCSO Act. Allegation has been made against the petitioner to have kidnapped the victim girl for the purposes of marriage. Later on, the victim girl has been recovered. Learned counsel for the petitioner submits that the petitioner is in custody since 19.12.2017 i.e. for more than 3 years.

Looking to the period of custody, let the petitioner, above-named, be released on bail on furnishing bail bond of

Patna High Court CR. MISC. No.75048 of 2019(5) dt.09-03-2021 2/2 Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, 1st -cum- Special Judge, POCSO, Patna, in connection with Bakhtiyarpur P.S. Case No. 560 of 2017, subject to the condition that the petitioner would cooperate in the proceeding of the court below. In the event of failure to appear on two consecutive dates, the court below will be at liberty to pass appropriate order including cancellation of bail bonds of the petitioner.
