Mr.Lalan Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-01-2020 Petitioner seeks regular bail in connection with Asaon P. S. Case No. 78 of 2019 registered for the offence punishable under Sections 341, 323, 324, 307, 302/34 of IPC. As per prosecution case, several accused persons altogether eleven in numbers including the petitioner assaulted the mother of the informant causing her death. Submission of the learned counsel for the petitioner is that he has falsely been implicated in this case. He is residing another village and moreover, no specific allegation has been attributed against him. He is custody since 22.07.2019, having no criminal antecedent.
Heard learned A.P.P. as well as learned counsel for the informant who appeared suo-motu has opposed the prayer for bail on the ground that altogether seven injuries were found on
Patna High Court CR. MISC. No.73957 of 2019(3) dt.16-01-2020 2/2 the person of the deceased, charge-sheet has also been submitted against these petitioners.
Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Judicial Magistrate First Class, Siwan, in connection with Asaon P. S. Case No. 78 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
