1. Heard learned counsel for the petitioner and the learned Special P.P. for the Vigilance Mr. Arvind Kumar.
2. The petitioner apprehends her arrest in Imamganj P. S. Case No.171 of 2020 registered for the offences punishable under Sections 467, 468, 471, 420, 120(B) of the Indian Penal Code.
3. The learned counsel for the petitioner submits that this is the second attempt of the petitioner to seek anticipatory bail as earlier the anticipatory bail application of the petitioner was rejected by an order dated 28.07.2023 in Cr. Misc. No.18213/2023 on the ground that in the F.I.R. the name of the father of Geeta Das is recorded as Bal Swaroop Chauhan while petitioner (Geeta Das) is daughter of Ramsunder Ram as such
Patna High Court CR. MISC. No.6430 of 2025(4) dt.19-03-2025 2/3 she not being the daughter of Bal Swaroop Chauhan, does not have any apprehension of arrest. The learned counsel for the petitioner submits that in the F.I.R. the name of the father of the petitioner was incorrectly typed as Bal Swaroop Chauhan instead of Ramsunder Ram for which the petitioner after passing of the order dated 28.07.2023 in Cr. Misc. No.18213/2023 had petitioned the Investigating Officer of the case for getting the name of her father rectified in the F.I.R. and the Investigating Officer by her letter dated 05.05.2024 addressed to the learned Judicial Magistrate 1st Class, Sherghati had prayed to rectify the father's name of the petitioner.

It is further submitted that petitioner is a person with clean antecedent and is a woman and the informant alleges that she secured appointment as Teacher based on forged certificate of Intermediate. It is next submitted that petitioner has been falsely implicated in the present case and the F.I.R. came to be instituted based on an inquiry conducted behind her back and no opportunity was given to her to explain her side of the case. It is also submitted that had an opportunity being given to the petitioner to explain her case, then perhaps the present F.I.R. would not have been instituted nor her father's name would have been incorrectly recorded in the F.I.R.

5. Learned Special P. P. for the Vigilance opposes the anticipatory bail application of the petitioner.
6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of her arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Imamganj P.S. Case No.171/2020, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
