The petitioner seeks regular bail in connection with Nawada (Town) P.S. Case No. 463 of 2018 for the offence registered under Sections 25(1-b), 26 and 35 of the Arms Act. The allegation is regarding recovery of two country made pistol and 10 live cartridges from the house of the coaccused, namely, Sharvan Kumar. It is alleged that the petitioner was apprehended by the Police and thereafter on his disclosure the said recovery is stated to have been made. The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case. It is further submitted that no recovery of illicit arms has been made either from the possession of the petitioner or

Patna High Court CR. MISC. No.81576 of 2019(2) dt.11-12-2019 2/2 from his house. Lastly, it is submitted that the petitioner is languishing in custody since 25.07.2018.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VI, Nawada in connection with Nawada (Town) P.S. Case No. 436 of 2018.
