2. The petitioner seeks regular bail in connection with Pipra P.S. Case No.218 of 2020, registered for the offences punishable under Sections 406, 409, 420, 120(B) of the Indian Penal Code.

3. As per the prosecution case, the informant who is Block Panchayati Raj Officer, Pipra alleged that the accused persons committed serious irregularities in construction of Yojna No.01/2019-20, 02/2019-20 and 03/2019-20 under "Mukhyamantri Grameen Gali-Nali Pakki-Karan Nischay Yogna in Ward No.7 of Duiyahi Panchayat and they have embezzled the government money and did not get the work

Learned counsel for the petitioner submits that the petitioner is a retired Panchayat Secretary of the concerned Panchayat and he has been falsely implicated in this case due to non completion of work under three scheme of the Government and the petitioner has already deposited the total advance amount to the tune of Rs.13,92,600/- in the bank account of the concerned Panchayat and as such there is no dues against him. He further submits that petitioner is an old aged person, he is in jail custody since 14.06.2023 and charge sheet has already been submited in this case. Learned counsel submits that petitioner has one criminal antecedent. He further submits that similarly situated co-accused namely Badri Narayan Sardar has already been granted bail by the Co-ordinate Bench of this Court vide order dated 17.08.2021 passed in Cr. Misc. No.30324 of 2021.

5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

Considering the facts and circumstances of the case and the submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief
