2. The petitioner has preferred this application for grant of regular bail in connection with Maranga P.S. Case No. 16 of 2025 dated 17.01.2025 registered for the offences punishable u/ss 103, 303(2), 62 read with Section 3(5) of the B.N.S. and Section 27 of the Arms Act.
3. As per the prosecution case, on hearing the noise, the informant's father, Md. Rafik came out of the house and was urinating on the road side. Suddenly, two unknown persons riding on a motorcycle were passing. The informant's father asked them about the noise in the village, in the meantime, a person sitting behind on the motorcycle fired from

No.81557 of 2025(2) dt.08-12-2025 2/3 his gun which hit the informant's father causing injury on his left thigh due to which blood started oozing out and he fell down on the ground. The accused persons fled away from the spot. The informant's father was taken to the hospital and during the course of treatment, he died. It is further alleged that the accused persons had come to steal fertilizer from the godown of Mohamad Imran in Kakarjan village.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. The petitioner is not named in the F.I.R. The name of the petitioner has sprung up in the confessional statement of the co-accused, Rahmat Ansari. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has no concern with the alleged offence. The co-accused persons have already been granted regular bail by this court vide order dated 20.08.2025 passed in Cr. Misc. No. 38318/2025. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 26.04.2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances
Patna High Court CR. MISC. No.81557 of 2025(2) dt.08-12-2025 3/3 of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Purnea in connection with Maranga P.S. Case No. 16 of 2025 with the condition :- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
7. The application stands allowed.
