2. The petitioner is apprehending his arrest in connection with Siswan (Chainpur O.P.) P.S. Case No. 285 of 2022 for the offence under sections 302/34 of the I.P.C. and Section 27 of the Arms Act lodged on 14.11.2022 by the informant, Jay Narayan Singh.

3. As per the prosecution story, the informant alleged that on 13.11.2022 while his son Ritesh Singh was coming from Nawada, had got gun-shot injury, was rushed to Referal Hospital, Siwan there he breathe his last. Accordingly, the F.I.R. against unknown.

4. Learned counsel for the petitioner submits that the main culprit is Vikash Kumar Singh who along with Prince

Patna High Court CR. MISC. No.266 of 2024(4) dt.26-04-2024 2/2 Bharti, as per investigation opened fire causing killing of the sone of the informant. This petitioner has been named as an accomplice .

Learned APP opposes the prayer on the other hand submits that the Vikash Kumar Singh subsequently made confession which has come in paragraph 61 of the case diary where he made statement that it was on the request of this petitioner with further offer of Rs. 2,00,000/- to be paid in case Ritesh Singh is killed, the said occurrence took place. The further confession is that Rs. 20,000/- was paid by this petitioner whereafter, he absconded.

6. This is an anticipatory bail application and the allegation is of killing Ritesh Singh, the main accused has named this petitioner as the person on whose behest the said killing took place.

7. In that background, it would be appropriate that the petitioner seeks bail, the anticipatory bail application stands rejected.
