The petitioner seeks bail in Chandi P.S. Case No. 125 of 2017 registered under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

85 liters of country made liquor is said to have been recovered from the possession of the petitioner and one Pintu Nut. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. The liquor was seized from a football field. He has been falsely implicated in this case due to dirty village politics. He has no criminal antecedent.

Patna High Court Cr.Misc. No.9114 of 2018 (02) dt.17-02-2018 2/ 2 Similarly situated accused Pintu Nut has already been enlarged on bail by a coordinate Bench of this Court in Cr. Misc. No.3793 of 2018 vide order dated 25.01.2018. The petitioner has been languishing in custody since 19.11.2017.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge-IV, Bhojpur at Ara in connection with Chandi P.S. Case No.125 of 2017.
