JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 18-06-2020 Heard learned counsel for the petitioner, learned Additional Public Prosecutor for the State and learned counsel for the informant via video conferencing.

The petitioner seeks pre-arrest bail in connection with Pupri P. S. Case No.307 of 2019 registered under Sections 341, 323, 324, 307/34 of the Indian Penal Code.

It is contended by the learned counsel for the petitioner that save and except Section 307 of the Indian Penal Code, all other sections are bailable in nature. It is further contended that the injuries sustained by the informant are all simple in nature.

Learned Additional Public Prosecutor for the State and learned counsel for the informant have opposed the prayer for

Patna High Court CR. MISC. No.76193 of 2019(3) dt.18-06-2020 2/2 grant of pre-arrest bail to the petitioner.

Regard being had to the fact that the injuries caused to the informant Gautam Kumar have been found to be simple in nature by the doctor, who examined him as also that pandemic Covid-19 situation in the State is getting worse, the petitioner named above is directed to be released on bail, in the event of arrest or surrender before the court below, on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Pupri, Sitamarhi in Pupri P. S. Case No.307 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. (Ashwani Kumar Singh, J) kanchan/- U T
