The petitioner is languishing in custody in connection with Patliputra P.S. Case No. 432 of 2019 for the offence punishable under Section 30(a) & 38(i) of the Bihar Prohibition and Excise Act, 2016.

Allegation is regarding recovery of 45 litres of illicit country made liquor from an Auto Rickshaw and it is alleged that the same was of the petitioner. Petitioner was apprehended at the spot. Petitioner has stated on oath that he has got no criminal antecedent.

Learned counsel for the petitioner submits that the petitioner is in custody since 25.09.2019.

No.75912 of 2019(2) dt.29-11-2019 2/2 Considering the facts aforesaid, let the petitioner, above named, be released on bail after completion of investigation on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending in connection with Special Case No. 8587 of 2019 arising out of Patliputra P.S. Case No. 432 of 2019, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned court below; and (b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
