The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 272, 273 of the Indian Penal Code and 30 (a), 38 (1) of the Bihar Prohibition and Excise Act.
Learned counsel for the petitioner submits that there is recovery of 1.080 liters of foreign liquor from the electric shop of the petitioner and electric shop is jointly run by the petitioner and his family members. There is no recovery from the conscious possession of the petitioner. The petitioner has no criminal history.
In the aforesaid facts and circumstances of the case, I
Patna High Court CR. MISC. No.73618 of 2019(2) dt.22-11-2019 2/2 am inclined to grant anticipatory bail to the above named petitioner, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, Muzaffarpur, in connection with Katra P.S. Case No. 214 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. Subject to further condition is that the petitioner shall deposit Rs. 2,000/- in the Patna High Court Legal Services Committee, Patna.
