Petitioner seeks regular bail in connection with Musahari P.S. Case No.197 of 2019, for the offences punishable under Section 392 of the Indian Penal Code.

The petitioner is not named in the First Information Report and the prosecution story in brief is that the informant was intercepted by two unknown persons on the gun point and a sum of Rs.5,000/-, one golden locket and Redme mobile phone were snatched from the informant by the said two unknown persons.

Mr. Vipin Kumar, learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged. Learned counsel further submits that the petitioner has got no criminal antecedent and he has been

No.73845 of 2019(2) dt.11-12-2019 2/2 dragged in this case on the basis of the fact that the stolen snatched mobile was found in possession of the petitioner which according to learned counsel, the petitioner had purchased the same from one Prabhat Kumar Mishra. Learned counsel further submits that Prabhat Kumar was arrested in this case and has confessed that he has committed the offence along with other person, namely, Arvind Rai. Learned counsel by referring Annexure-2 submits that the petitioner is student and is studying in B.A. Part-1 and he is in custody since 26.08.2019. Having regard to the submissions made by the parties and taking into consideration the fact that the petitioner is student having no criminal antecedent and he is in custody since 26.08.

2019, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VI, Muzaffarpur, in connection with Musahari P.S. Case No.197 of 2019, subject to the condition that one of the bailor will be his father.
