ANJANA MISHRA ORAL ORDER 04-12-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 24.08.2019 in connection with Charpokhari P.S. Case No.173 of 2017 for the offence under Sections 392, 395 and 412 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has been taken into custody only on suspicion and thereafter he was made to confess before the police, which has no evidentiary value. It is further submitted that till date, no T.I. Parade has been conducted nor has there been any recovery made from his personal possession. It is further submitted that co-accused Rahul Kumar has since been extended the privilege of bail in Cr.Misc. No.60153 of 2018

Patna High Court CR. MISC. No.79397 of 2019(2) dt.04-12-2019 2/2 vide order dated 09.10.2018. Learned counsel for the petitioner also submits that save and except one other case in which he is on bail, the petitioner has no criminal antecedents. In view of the aforementioned facts and circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the court of learned C.J.M., Bhojpur at Ara, in connection with Charpokhari P.S. Case No.173 of 2017.
