2. The petitioners apprehend their arrest in a case registered for the offence under Sections 406, 419, 420 and 34 of the Indian Penal Code.

3. It is alleged that informant had given Rs. 3,25,000/- to the petitioners to purchase a piece of land but petitioners gave other land worth Rs. 1,25,000/- and when informant demanded his rest money, the petitioners assaulted him and refused to return the rest money.

4. It is submitted on behalf of petitioners that petitioners have been falsely implicated in this case. Petitioner

Patna High Court CR. MISC. No.82712 of 2023(4) dt.01-05-2024 2/2 no. 1 is property dealer and petitioner no. 2 his wife. Present case is counter blast of complaint case No. 620 of 2022, filed by petitioner no. 1 against informant. Moreover, the dispute is purely of a civil nature, however; colour of criminal offence has been given. Petitioners claim clean antecedent.

5. Learned A.P.P. for the State has opposed the bail petition.

6. Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Bagaha, West Champaran in connection with Ram Nagar P.S. Case No. 531 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) anay/- U T
