JUSTICE MOHIT KUMAR SHAH ORAL ORDER 19-07-2022 The short prayer of the petitioner in the present case is for enforcement of the order dated 29.11.2017 passed by the Circle Officer, Paharpur, District-East Champaran at Motihari,
Patna High Court CWJC No.3301 of 2018(3) dt.19-07-2022 2/2 whereby and whereunder in pursuance to the order passed in Encroachment Case No. 23 of 2016-17, police force has been requisitioned for removal of the encroachment in question, however, the encroachment could not be removed on account of non-availability of the police force.
Having regard to the short prayer made by the learned counsel for the petitioner, I direct the District Magistrate, East Champaran at Motihari to make an enquiry in the matter and take appropriate steps, in accordance with law, within a period of eight weeks of receipt/production of a copy of this order. The writ petition stands disposed off on the aforesaid terms.
