The petitioner seeks bail in connection with Kharik P.S. Case No. 154 of 2019 dated 14.07.2019 instituted for the offence under Sections 419, 420, 467, 468, 471, 386, 387, 354, 354B, 504 and 506 of the Indian Penal Code.

The accusation in the FIR does not reveal any specific offence except for the petitioner having misused his mobile telephone on one occasion and blackmailing others who are related to the informant.

The petitioner is in custody since 14.07.2019. It has been submitted that the petitioner and the informant were known to each other and the accommodation loan which was granted by the petitioner

Patna High Court CR. MISC. No.74209 of 2019(2) dt.04-12-2019 2/2 to the informant was not likely to be returned. Only to prevent the petitioner from demanding his money back, the subject FIR has been lodged. Seeing the futility of the case however, the parties have entered into a settlement.

Considering all these facts and especially the custody of the petitioner, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 1st Naugachia, Bhagalpur in connection with Kharik P.S.
