The petitioner who is in custody since 12.8.2019 has filed the instant application for grant of bail in connection with Kiul Rail P.S. Case No. 147 of 2019 (District- Lakhisarai) registered for the offence punishable under sections 379 and 411 of the Indian Penal Code.
As per the allegation in the FIR, on hulla being raised by the informant the petitioner was chased and caught and a sum of Rs. 560/- belonging to the informant was recovered.
It is submitted by learned counsel for the petitioner that allegations as per F.I.R. are false and concocted. The petitioner had a dispute with respect to the seat arrangement in
Patna High Court CR. MISC. No.77630 of 2019(2) dt.03-12-2019 2/2 the train which led to lodging of a false case against the him. He is in custody since 12.8.2019 and charge sheet has been submitted in the case. It is further submitted that the offence is triable by the Magistrate.
The application for bail was opposed by learned APP for the State.
Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, let the petitioner above named be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Railway Judicial Magistrate, Kiul (Lakhisarai) in connection with Kiul Rail P.S.
