The petitioner seeks anticipatory bail in connection with Rajauli P.S. Case No.429 of 2024 registered for the offence punishable under Section 30(a) of the Bihar Prohibition & Excise Act, 2016.

About 130 litres of country made liquor has been recovered from two motorcycles. The petitioner is the owner of one of the motorcycles.

Learned counsel for the petitioner submits that the petitioner is ready to denote Rs.25,000/- in some charitable organization without accepting his guilt. 5.

Considering the facts and circumstances of the case, this bail application is allowed.

Let the petitioner, above named, in the event of his arrest/surrender within six weeks from today in the Court

Patna High Court CR. MISC. No.84787 of 2024(2) dt.08-01-2025 2/2 below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Judge, II, Nawada, in connection with Rajauli P.S. Case No. 429 of 2024, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is also subject to the condition that the petitioner shall deposit an amount of Rs.25,000/- in Ramakrishna Mission Ashrama, Nala Road, Patna and produce the receipt of the same before the court below at the time of furnishing the bail bonds. The bail bonds of the petitioner shall be accepted by the court below after verifying the genuineness of the receipt produced by the petitioner.

As a condition of this order, the petitioner shall mark his attendance in Rajauli Police Station, DistrictNawada on first and third Sunday of each month. Any default in appearance at the Police Station would result in cancellation of the bail bonds of the petitioner.
