JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-11-2019 Learned counsel appearing for the petitioner submits that the petitioner being the Passenger Clerk at Transport Depot, Jamui was suspended vide order no.303/2017 communicated through memo no.1086 dated 21.11.2017 and charge was communicated on 06.12.2017 but his suspension was revoked taking into consideration view expressed by Inquiry Officer with warning withholding the salary of suspension period except the subsistence allowance by the Regional Manager, Bhagalpur through order dated 125/2018 dated 21.06.2018. Against the said order the petitioner has filed the appeal (Annexure-12) before the Administrator, Bihar State Road Transport

Patna High Court CWJC No.23428 of 2019(2) dt.28-11-2019 2/2 Corporation, Patna on 13.07.2018 but the appeal is still pending for disposal and there is no progress in the appeal. Having regard to the facts and circumstances of the case and the submission of the learned counsel for the petitioner this writ application is disposed of with a direction to Administrator, Bihar State Road Transport Corporation, Patna (respondent no.1) to dispose of the appeal of the petitioner (Annexure-12) in accordance with law within three months of receipt/production of a copy of this order.
