JUSTICE MADHURESH PRASAD ORAL ORDER 06-04-2018 Heard counsel for the petitioner and the State. Petitioner is an accused in a case registered for offence under section 302 IPC.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case on the basis of suspicion. It is apparent from the FIR itself that there was some intimacy between the petitioner an the victim/the deceased, and the victim had been restrained from her family to meet with the petitioner, whereafter she committed suicide. Charge sheet has been submitted in this case under section 306 IPC.

Prior to the lodging of the instant case, the petitioner has no criminal antecedent. Petitioner is in custody since 18.12.2017. Considering the aforesaid submissions, prayer for bail of the petitioner is allowed. Let the petitioner, mentioned above, be

No.12736 of 2018 (3) dt.06-04-2018 released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate VII, Darbhanga in Keoti Police Station Case No. 126 of 2016 on the following conditions:- (a) One of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner (b) The Petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
