The petitioner seeks bail in Motihari Town P.S. Case No. 280 of 2019 instituted for the offences under Sections 341, 307, 324, 326/34 of the Indian Penal Code.

The earlier bail application of the petitioner was rejected vide Annexure-1 to the present application taking into account that the petitioner is an assailant.

A report was called for from the Court below. It has been reported that out of nine prosecution witnesses, five have been examined and the trial is expected to be concluded within a period of nine months.

Patna High Court CR. MISC. No.75511 of 2019(3) dt.04-03-2020 2/2 Considering the nature of accusation and the stage of the case, I am not inclined to grant bail to the petitioner. The same is rejected. The Trial Court is directed to conclude the trial at the earliest preferably within a period of four months from the date of receipt/production of a copy of this order.
