ANJANA MISHRA ORAL ORDER 24-01-2020 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Ramgarh P.S. Case No.192 of 2019 registered for the offence punishable under Sections 341, 323, 324, 307, 504, 506/34 of the Indian Penal Code.

Learned counsel for the petitioners submits that the petitioners have been named as accused and are said to have

Patna High Court CR. MISC. No.73959 of 2019(2) dt.24-01-2020 2/2 assaulted the father and the uncle of the informant with traditional weapons, as a result of which they sustained injuries. Learned counsel for the petitioners further submits that the petitioners have been falsely implicated on account of land dispute. A bare perusal of the F.I.R. would reveal that the allegations against these petitioners are general and omnibus in nature. It is submitted that a title suit is pending for declaration of title and they have been falsely implicated in this case.

Considering the aforementioned facts and circumstances and that these petitioners have no criminal antecedents, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-1st, Kaimur at Bhabua or successor court, in connection with Ramgarh P.S. Case No.192 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
