2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 341, 323, 324, 325, 354B, 379, 427, 448, 504 & 506/34 of the Indian Penal Code and Section 8 of the POCSO Act.

3. The allegation in the first information report is that due to some property dispute a quarrel had taken place between the informant and her sister-in-law (Gotani) due to which the accused persons including the petitioner assaulted her husband on head and misbehaved with her daughter.

It is submitted by learned counsel for the petitioners that it would be apparent from the first information report itself that the informant and the petitioners are closely related to each other and there is also a property dispute in the family. So far as the allegation of assaulting the husband of the informant and other persons are concerned, the injury report, which is part of the case diary, would reveal that the injuries are simple in nature. Further, with regard to an allegation upon the petitioner of misbehaving with the daughter of the informant is also not supported by any concrete evidence collected during the course of investigation. Further, a case has also been filed by the father of the petitioner against the informant and others earlier to the case in hand. Hence, there is also a counter version of the whole story.

5. Learned APP for the State opposed the prayer for bail.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned lower Court where the case is pending/successor Court in connection
