This is an application for regular bail in connection with Manjhagarh P. S. Case No. 272 of 2017 registered for the offences punishable under Sections 379, 328, 396, 412, 413, 120B of the Indian Penal Code.

According to informant, his truck loaded with edible oil proceeded from Gwalior to Areraj but it did not reach its destination on time. On enquiry made he got information that it was missing along with driver and khalasi after reaching Manjhagarh.

It is submitted on behalf of petitioner that he is not named in the FIR. His name has surfaced on the basis of confessional statement. No incriminating material was recovered from the possession of petitioner. Petitioner has no

Patna High Court Cr.Misc. No.15629 of 2018(3) dt.12-04-2018 2/2 criminal antecedent. He is in judicial custody since 30.11.2017. It has further been submitted that similarly placed co-accused persons have been granted bail on 6.4.2018 by this Court vide Cr. Misc. No. 14479 of 2018.

Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned CJM, Gopalganj in connection with Manjhagarh P. S. Case No. 272 of 2017.
