2. The petitioner apprehends his arrest in connection with Rajepur P.S. Case No. 85 of 2016 registered for the offence under Sections 143, 144, 145, 147, 148, 149, 151, 152, 153A, 160, 395, 295A, 297, 298, 341, 323, 342 and 504 of the Indian Penal Code.

3. As per the prosecution case, it is alleged by the informant that 200-300 persons came to his shoe shop and raised anti-Muslim slogans and also looted shoes worth Rs. 3,00,000/- and 8,000/- cash.

4. It has been submitted by the learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in this case. He further submits that the

Patna High Court CR. MISC. No.80739 of 2025(4) dt.10-03-2026 2/2 petitioner has not been named in the FIR and he has only been implicated in this case on the basis of supervision note of the Deputy Superintendent of Police.

7. Considering the aforesaid facts, this application is allowed.

8. Let the petitioner, above named, in the event of his arrest or surrender before the concerned Court below within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Sadar, East Champaran, Motihari/concerned Court below in connection with Rajepur P.S. Case No. 85 of 2016, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973 / Section 482 of the BNSS.
