Petitioner apprehends his arrest in Darbhanga Town P.S. Case No.277 of 2014 instituted for the offence under Section(s) 406, 409, 420, 467, 468, 471, 472, 120-B Indian Penal Code.
Counsel for the petitioner has submitted that the police after investigation did not sent up this petitioner for trial. The Court below has taken cognizance against the petitioner also along with other accused persons.
Counsel for the petitioner has submitted that there is no allegation that he has misappropriated the amount. The petitioner on transfer joined in Darbhanga Town Chowk Branch
Patna High Court Cr.Misc. No.15908 of 2018 (2) dt.04-04-2018 2/3 of United Bank of India on 05.11.2014 and two cheques were already deposited on 08.07.2014 and 12.08.2014, which were handled by the employee of the bank working on those dates. After one week of joining of the petitioner, on 14.11.2014, third cheque was also handled by the employee of the bank, who was concerned with that. The petitioner was Branch Manager. He did not handle the work of RTGS.
In the facts and circumstances of the case, prayer of the petitioner for grant of anticipatory bail is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today in connection with Darbhanga Town P.S. Case No.277 of 2014, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-IV, Darbhanga, subject to the conditions as laid down under Section 438(2) Cr. P. C. with further conditions: (1) bailors should be local having sufficient immovable property within the jurisdiction of the court concerned, (2) petitioner shall cooperate in the trial and shall be present on each and every date fixed by the court and his absence on two consecutive dates without proper and reasonable reason will be liable to cancel his bail bond and (3) if petitioner tampers
Patna High Court Cr.Misc. No.15908 of 2018 (2) dt.04-04-2018 3/3 with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
