JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-12-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 30(a) (c) (d) of Bihar Prohibition and Excise Act, 2016.

According to prosecution case itself, the alleged recovery of illicit liquor was made from Bhatti of Rajesh Yadav and Krishna Yadav. So far as petitioner is concerned, petitioner was caught on the spot but he disclosed that he was working as labourer at the Bhatti of Krishna Yadav. Moreover, petitioner does not have any criminal antecedent and is languishing in jail custody since 05.09.2019.

Considering the aforesaid facts and circumstances as
