JUSTICE ARUN KUMAR ORAL ORDER 22-03-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in K. Hat PS Case No. 691 of 2017 (Sessions Trial No. 6 of 2018) registered under Sections 379 and 411 of the IPC.

Submission is that the stolen motorcycle was not recovered from the possession of the petitioner rather recovery is from the possessionof Dhiraj Kumar and only material against the petitioner is disclosure of his name by co-accused Rahul Paul in his confessional statement, subsequent to the present case the petitioner has been made accused in other cases and in those cases also there is no recovery from the possession of the petitioner. Having considered the said facts and circumstances, the petitioner, namely, Ashif Ahmad @ Md. Ashif Ahmad is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Fast Teack Court, 2, Purnea in connection with K.
