2. The petitioner in paragraph no. 1 of the present writ petition has sought inter alia the following relief(s), which is reproduced hereinafter:- "(A)Also for quashing the letter no. 401 dated 06-07-2019 as contained in Annexure- 9 issued under the signature of District Education Officer, Araria

Patna High Court CWJC No.2430 of 2020(4) dt.10-02-2025 2/3 indicating private respondent Muneshwar Prasad Singh has passed in two different examination is based on no evidence.

(B) For quashing the order dated 22-072019 as contained in Annexure- 12 passed by the State Information Commissioner, in case No. A 8540/18 by which case No. A 8540/18 has been rejected and to that effect office order vide Memo No. 2686 dated 22-07-2019 issued under the signature of Principal Private Secretary, to the State Information Commissioner, Bihar, Patna.

(C) Also for directing the state respondents to take appropriate action in terminating the services of Dhruv Kumar Singh Private respondent Muneshwar Prasad Singh, Son of Baleshwar Prasad Singh, Resident of village Dhokaria, PS+ District- Araria who is continuing in the service on the basis of date of birth showing 02-06-1982 having qualification of Madhyama from Sasakrit High School Madanpur issued by Bihar Sanskrit Shiksha Board in the year 2002 after suppressing or cancelling the actual date of birth 21-121965 recorded in School Leaving Certificate issued by the Headmaster Middle School-Dehti, Purnea and qualification of Matriculation issued by the Bihar School Examination Board in the year 1983 having roll No.

0002 Roll Code 4222 and regular student of Middle School Dehti and later on student of Jakir Academy High School Dehti, recover all the salary received by the private respondent and registering FIR by the vigilance Department after conducting the inquiry.

3. In view of the information contained in para-13 to the writ petition, I find that the petitioner has already filed a complaint before the learned Lokayukta, Bihar, Patna and the same had been registered to be adjudicated by him on 29.11.2018 (Annexure - 11 to the writ petition), the present writ petition is disposed of with a liberty to the petitioner to pursue remedy before the learned Lokayukta, Bihar, Patna.
