Tiwari, learned advocate for the petitioner submits that against the order of cancellation of PDS license of the petitioner, he has appealed before the District Magistrate, Vaishali at Hajipur on 26.02.2019 vide Appeal Case No. 50/2018-19. However, the aforesaid appeal has not yet been disposed off.

Mr. Tiwari, learned advocate submits that he shall be satisfied in the event of a direction to the appellate authority viz. the District Magistrate, Vaishali

Patna High Court CWJC No.23947 of 2019(2) dt.03-12-2019 2/2 at Hajipur to dispose off the appeal within a reasonable period of time/stipulated time frame with a reasoned order.

The District Magistrate, Vaishali at Hajipur/respondent No. 2 ought to have, up till now, disposed off the appeal as ten months have passed by since the same was filed. No direction is required to an authority to perform his obligation.

In any view of the matter, this Court directs the District Magistrate, Vaishali at Hajipur/respondent No. 2 to dispose off the appeal of the petitioner as early as possible but not later than 10th of January, 2020. Let a copy of this order be produced before the appellate authority by the petitioner.

With the aforesaid observation/direction the writ petition stands disposed off.
