2. The petitioner apprehends arrest in a case registered under Sections 274, 275, 3(5) of Bhartiya Nyaya Sanhita and Sections 30(a) and 41 of Bihar Excise Act.
3. As per prosecution case, 93 liters illicit liquor has been recovered from Maruti Suzuki Car bearing Reg. No. DL3C-BJ-4314. Apprehended accused persons disclosed the name of this petitioner.
4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case merely on the confessional statement of co-accused Sri Ram Kumar and Sanjay Kumar. Further submission is that petitioner is neither the owner nor the
Patna High Court CR. MISC. No.83965 of 2024(3) dt.27-01-2025 2/2 driver of the seized vehicle. Nothing has been recovered from the conscious possession of the petitioner. Petitioner has got no criminal antecedent.
5. Learned A.P.P. for the State opposed the prayer for bail.
6. Having considered the aforesaid facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of eight weeks from today, on furnishing bail bond of Rs. 10,000 (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise Act, Jhanjharpur, Madhubani, in connection with Jhanjharpur P.S. Case No. 167 of 2024, giving rise to G.R. No. 694 of 2024, subject to the conditions as laid down under Section 482(2) of the B.N.S.S., 2023. (Prabhat Kumar Singh, J) utkarsh/- U T
