The petitioner seeks pre-arrest bail in connection with Vishnupad P.S. Case No. 84 of 2019 registered under Sections 509 and 506/34 of the Indian Penal Code and Section 66(C) of Information Technology (Amendment) Act, 2008. It is submitted by the learned counsel for the petitioner that save and except Section 66C of the Information Technology Act, 2000, all other Sections under which the case has been registered is bailable. It is further contended that since there is no allegation that the petitioner fraudulently or dishonestly made use of the electronic signature, password or any other unique identification feature of any other person, the ingredients of Section 66C of the aforesaid Act are not attracted.

Regard being had to the nature of allegation and the submissions made above, in the event of arrest or surrender before the court below, the petitioner named above is directed to be released on bail, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Vishnupad P.S. Case No. 84 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Ashwani Kumar Singh, J) rohit/- U T
