2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 103 (1), 3(5) of the B.N.S.
3. The case of the prosecution is that on 23.07.2024 at about 6:10 P.M. the husband of the informant said that he is going to collect money from Anil Mahato and after that he will go to Deoghar. It is further alleged that when her husband did not return for a considerable time, the informant called on his mobile which was going switched off. In the morning, he came to know that dead body of her husband is laying near canal. In the later part of the FIR, it is alleged that on the same day, Naga Mahato has threatened the father-in-law of the informant that he will kill the deceased. During the course of investigation, it
Patna High Court CR. MISC. No.83311 of 2024(3) dt.04-02-2025 2/2 has come that Anil Mahato and Manoj Mahto (the petitioner herein) have confessed that they assaulted the deceased.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that except the confession, there is no material in the case diary to implicate him. Moreover, the petitioner is languishing in judicial custody since 04.08.2024 having no criminal antecedent.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Sirsia P.S. Case No. 57 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st, West Champaran, Bettiah.
