====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 19-03-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Dulhin Bazar P.S. Case No.105 of 2019 registered under Sections 341, 323, 354(B) and 504 of the Indian Penal Code. The accusation is that in the late evening of 23.04.2019, the informant Janakia Devi was at her door and talking to her husband on mobile phone. At that time, her villager Umesh Bind alias Hathi Singh (petitioner) armed with 'Belcha' came there and enquired from her about the person to whom she is talking, on which she replied that she is talking to her husband. Thereafter, the petitioner started to abuse the informant and caused blood oozing injury through 'Belcha' at

Patna High Court CR. MISC. No.74719 of 2019(3) dt.19-03-2020 2/2 her right elbow. In that course, this petitioner torn the blouse of the informant and dashed her on the ground.

Learned counsel appearing on behalf of the petitioner submits that due to petty dispute, the occurrence of scuffle took place in between the informant and this petitioner but with an ulterior motive, the informant has lodged the present case against the petitioner with false allegation. The petitioner has no criminal antecedent and is in custody since 17.07.2019. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri P.K. Malviya, Judicial Magistrate, First Class, Danapur, Patna, in connection with Dulhin Bazar P.S. Case No.105 of 2019.
