Petitioner is apprehending his arrest in connection with Fatuha P.S. Case No.485 of 2024, registered for the offence punishable u/s 309(4) of BNS, 2023.

Allegedly, the petitioner along with other co-accused persons have assaulted the informant and snatched his Redmi mobile, one purse with aadhar card and Rs.400/- in it and also snatched Rs.8,000/- cash from his pocket.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has not committed any offence. He has been falsely implicated in this case. The petitioner lives at Delhi and worked there as daily worker. Name of the petitioner transpired on the basis of confessional statement of

Patna High Court CR. MISC. No.86983 of 2024(2) dt.18-12-2024 2/2 co-accused person Arman Kumar, which has no evidentiary value in the eye of law. Nothing has been recovered from the house or conscious physical possession of the petitioner. Petitioner has no criminal antecedent as mentioned in para 3 of the bail application.

Learned APP for the State opposed the prayer for bail by submitting that petitioner is involved in this case. 6.

Considering the aforesaid facts and circumstances and the nature of allegation, I am not inclined to enlarge the petitioner on bail. The prayer for grant of anticipatory bail on his behalf is hereby rejected.

This application is accordingly dismissed.
