The petitioner seeks bail in connection with Ujiyarpur P.S. Case No. 133 of 2017 for the offences punishable under Sections 302/34 of the Indian Penal Code. The allegation is regarding the petitioner having crushed to death a small child by tractor.

The learned counsel for the petitioner submits that admittedly there is dispute between the parties, the petitioner has been falsely implicated in the present case and is languishing in custody since 25.11.2017.

Having regard to the facts and circumstances of the case, which is substantiated from the material available in the case dairy as also the fact that a small child has been brutally
