The petitioner seeks bail in connection with C-III Case No. 281 of 2019 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2018. Learned counsel for the petitioner submits that there is recovery of 190.08 liters of foreign liquor from the Bolero Car. Learned counsel for the petitioner further submits that there is no recovery from the conscious possession of the petitioner. Learned counsel for the petitioner further submits that the petitioner is a passenger of the said vehicle. He further submits that the petitioner is in jail custody since 01.11.2019 and the petitioner has got not criminal antecedent.

No.74821 of 2019(2) dt.27-11-2019 2/2 In the facts and circumstances of the case, I am inclined to grant bail to the petitioner, subject to deposit of Rs.20,000/- in the court below/Nazarat. Let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 2nd Additional Sessions Judge-cumSpecial Judge (Excise), Siwan in connection with C-III Case No. 281 of 2019.

Such deposit of Rs.20,000/- shall abide by the outcome of the criminal case.
