The petitioner seeks bail in connection with Mirganj P.S. Case No. 209 of 2019 registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that there is recovery of 25.755 liters of foreign liquor from the motorcycle. Learned counsel for the petitioner further submits that the motorcycle does not belong to the petitioner. However, petitioner is arrested with the motorcycle. Learned counsel for the petitioner further submits that the petitioner is in jail custody since 26.08.2019 and he has got no criminal antecedent. In the facts and circumstances of the case, I am

Let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 2nd Additional Sessions Judge-cumSpecial Judge (Excise), Gopalganj in connection with Mirganj P.S. Case No. 209 of 2019.

Such deposit of Rs.10,000/- shall abide by the outcome of the criminal case.
