====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 27-11-2019 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in a case for the offence registered under Sections 302/34 of the IPC.

The prosecution story, in brief, is that while the informant and his deceased brother Vikash Paswan were trying to pacify the dispute cropped-up between their sister and her husband, the petitioner and others caught hold the informant and his brother upon which co-accused Ganesh Paswan stabbed the deceased in his chest and inflicted injury by knife on the head of the informant. However, in course of his treatment, Vikash Paswan succumbed to his injury.

It has been submitted by learned counsel for the petitioner that the petitioner is languishing in custody since

Patna High Court CR. MISC. No.76742 of 2019(2) dt.27-11-2019 2/2 08.07.2019. The petitioner has got no criminal antecedent. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The allegation of assault is alleged against coaccused Ganesh Paswan who is said to have given dagger blow to the deceased. There is no allegation of assault against the petitioner. No injury has been caused by the petitioner upon the deceased.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.- VI, Kaimur, Bhabua, in connection with Kudra P.S. Case No. 186/2019.
