2. The petitioner has preferred this application for grant of regular bail in connection with Sessions Trial No. 334 of 2024 arising out of Ekma P.S. Case No. 417 of 2023, G.R. No. 9333/2023 dated 08.10.2023 registered for the offences punishable u/ss 302 read with Section 34 of the Indian Penal Code and Section 27 of the Arms Act.
3. As per the prosecution case, some unknown miscreants are alleged to have shot the informant's father while he was going to home from his shop and during the course of treatment, he died.
4. Learned counsel for the petitioner has submitted
Patna High Court CR. MISC. No.83687 of 2024(7) dt.12-09-2025 2/3 that the petitioner is innocent and has falsely been implicated in this case. The petitioner has been made accused in this case merely on suspicion. The petitioner is not named in the F.I.R. The name of the petitioner has sprung up in the confessional statement of the co-accused, Govinda @ Musa. Learned counsel has further submitted that the specific allegation is against the co-accused, Govinda @ Musa who fired on the informant's father namely, Rajesh Kumar. Nothing has been recovered from the conscious possession of the petitioner. The charge-sheet has been submitted against the petitioner. The petitioner has one criminal antecedent as stated in para 3 of the bail petition. The petitioner was remanded in this case from Ekma P.S. Case No. 487 of 2023 and he is in custody since 17.01.2024.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner and submitted that the petitioner and the co-accused persons are involved in the commission of the murder of the informant's father.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court
Patna High Court CR. MISC. No.83687 of 2024(7) dt.12-09-2025 3/3 concerned, Saran at Chapra in connection with Sessions Trial No. 334 of 2024 arising out of Ekma P.S. Case No. 417 of 2023, G.R. No. 9333/2023, with the condition :- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
7. The application stands allowed.
