2. The petitioner has prayed for bail in connection with Chhatauni P.S. Case No. 445 of 2024 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act.

3. The case of the prosecution is that altogether 5 liters of country made liquor was recovered from the hut of one Rakesh Paswan. When police could not apprehend him, this petitioner has been implicated in this case.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. The petitioner is a lady and she has been falsely implicated in this case. She has no concern with the

Patna High Court CR. MISC. No.85270 of 2024(2) dt.07-01-2025 2/2 alleged recovery. There is no independent witness of the seizure list. She is having no criminal antecedent. She is in custody since 18.10.2024.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court No.1, East Champaran, Motihari, in connection with Chhatauni P.S. Case No. 445 of 2024.
