Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Protest-cum-Complaint Case No. 381 of 2018 registered for the offences punishable under Sections 323/498-A/494 of the Indian Penal Code.

It has been jointly submitted by the parties that the mediation has succeeded and the parties are staying together. It has also been submitted by the opposite party No. 2 that the

Patna High Court CR. MISC. No.73840 of 2019(7) dt.09-05-2022 2/3 petitioner is already married for the second time and for the present, he has entered into the compromise just to save himself from this criminal case and to get the privilege of anticipatory bail.

Under the facts and circumstances of the case, this court is granting anticipatory bail to the petitioner in view of the compromise in the mediation proceeding and if there is any complaint by the opposite party No. 2 in future about the failure of any of the terms of the compromise then the opposite party No. 2 has option to move this Court for cancellation of bail of the petition of the petitioner.

Considering the facts and circumstances of the case, the prayer of the petitioner for grant of anticipatory bail is allowed.

Accordingly, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Bikramganj, Rohtas, in connection with Complaint Case No. 381 of 2018, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
